A new set of guidelines prepared by the government to manage waste tyres will put the liability on the tyre companies as well as on dealerships.
According to the new draft guidelines in the Waste Tyres Management Rules, 2017, it is expected from the tyre companies to prepare and execute an ‘integrated waste tyre management plan’ which will include a whole comprehensive plan for collection and disposal of waste tyres equivalent to its annual production and import quantity for which they need to comply within a given time period. Tyre dealers, on the other hand, will accept waste tyres in lieu of new ones bought by customers and will be responsible for disposing of the same.
However, the tyre retailer can only accept as many waste tyres as new one bought by the customer and they will be responsible for sending the waste tyres to the ‘Authorised Waste Tyres Collection and Storage Centres’ in such a way so that at anytime it shall not stock more than “250 numbers or 5 tonnes of tyres, whichever is more”. Customers can also give the waste tyres directly to the centres, but they will be not paid for it.
As has been said by the sources that the draft does not go down well with the diktat that the tyre producer “shall not be allowed to produce, import, distribute and/or sell new tyres, unless it complies with the rules”. Since Automotive Tyre Manufacturers Association (ATMA) members are still studying the draft rules, hence they are not able to comment at the moment.
Also included in the draft:
1- Fine up to Rs. 1 Lakh and Rs. 5000/day for as long as the contravention continues leading to simple imprisonment.
2- Tyre manufacturer to provide an assessment with the quantities of tyres that are produced or imported that will become waste tyres.
3- How to manage waste tyres.
4- To provide options for the recycling or reuse of waste tyres or recovery of the energy from the waste tyres.
5- Indicating how the implementation will be financed.
6- Provide a mechanism for registering waste tyre transporters and responsibilities of waste tyres transporters.
7- Indicate the measures to be put in place to address the stockpiles of waste tyres and indicate the percentage of the stockpile that the producer will take responsibility for.
8- To ensure that the waste tyres will be delivered to the identified facilities.
